Hello,
You can be a passive partner (investor) in any startup (even without any visa). To be an active partner, you need to be a permanent resident or citizen in US. Here is a link for the details... Possibly, USCIS will ask for your updated employment contract and job description. RFE is usually sent to your lawyer.
I don't know why they split your wife's application. Did you marry after you applied for GC?

I had filed my I485 directly at TSC , the address which was listed on my I140 Receipt on June 25th as per the advise given by IO when i called the 800#

This question is for my friend. he has a Bcom (3 years bachlors from India) with certification of chartered accountant and cost accountant. He has a 6 years of post qualification experience in india (after ca and ) and now he has 6.5 years of experience in US. (Total post qualification experience is 11-12 years)
His lawyer said as this is a 3 years degree you dont qualify for EB2. lawyer also send us a case where DOL denied CA plus 3 years of bcom under EB2.
Can you help us if he qualify for EB-2, what is the best way to file.

...US GC or citizenship allows you visa waiver for visits to other countries but you need a work permit to work in another country.

Hi, My H1B on passport is expiring in mid Jan 2008. Similarly, I-94 is also expiring same time. I applied AOS in last week of July and hoping that I will get EAD by Dec but if it does not come by then, what are my options ? If I apply H1 in first week of Jan , would that be okay as I will have expired H1B stamp and I-94 in my passport. Please advise.

She does not need to do anything but get a job, fill form I-9 and start working again. She is in a period of authorized stay since her I-485 is pending. I don't think it's even necessary to apply H4 for her.

Gurus,
I have labor pending from a State A, now my employer is asking me to move to State B. However, my employer is willing to keep alive, labor process from State A and is also ready to file new labor from State B. Question is if labor A gets approved and if I apply I-140 on that labor, do I have to reapply I-140 for labor B, once labor B gets approved or I can use the same I-140?
Help is appreciated.

Well you can Jump start a car whose battery is dead but rest of the electrical system is good.
So after the jump start when engine starts it keeps running on alternator.
Economy's electical wiring (Financial system) is in a big mess so jump start may not work. ;)

I mean I know I need to go speak with the dept that handles intl students in my school?
But, like, any pointers or information to please assist me?

If you graduated 1 year ago and was no longer a student in this last year, and did not apply for OPT before graduation, then you are already out of status - your F1 status ceased when you graduated. Moreover, your I-94 most likely said D/S. So the I-94 covered your stay only during the time you maintained F1 status. So you have been accruing illegal presence time. 6 month of illegal presence would trigger 3 year ban on reentering US; and 1 year or more would trigger a 10 year ban.
The prudent thing for you to do is to go back to your home country, and come back with a proper VISA.

We got our EAD cards today.
We had gone for FP on Sept 19th and saw LUDs on Sep 20th on our I-485s. But the EAD cards came without our fingerprints. EAD cards came from the same Service center (Nebraska) where the FP notices came from. So wondering, how they did not include our fingerprints in the EAD card?? I had also checked with FBI helpline two weeks back and verified that the FPs were delivered to USCIS.
Anybody else in similar situation?

I've got couple of questions.
1. I'm on F1 and got pregnant. Can i take a break for sometime and get back to studies?
2. My husband is a GC holder..well we got married after he got GC ( i know what you guys must be thinking :-))...now can he apply for a family based GC for me, i kind of know that it takes atleast 4 yrs for me to get GC...but just wanted to make sure that he can apply while i'm on F1...pls share your views...

Th I-140 is not revoked yet, but the original company that filed it is going to split in to 2 separate companies by the end of the year and I think I-140 will become invalid after that right if the original company doesnt exist anymore??
