Hello All,
I am in a strange situation.
My attorney is about to file my I-1485 this week.
My details:
Previous company:
Perm PD: June 2006 EB2
I-140 EB2 approved in Nov/2006.
Current company:
PERM filed: Oct/24/2007
I-140 EB2 filed on Jan/31/2008
trying to recapture the old PD of June/2006.
Today, when I checked my I-140 status, it says "Request for Evidence sent" yesterday.
What are my options now? I do not know if I am eligible to go ahead and file my I-485 now ? What are the implications if I go ahead and file my I-485 now.? Please let me know your ideas.

I am new to this forum. I am a recruiter and I have a candidate for a position in the US who is close to getting an offer. Here is my situation, any help would be appreciated.
Candidate is a Canadian Citizen currently in the US working with TN (Nafta Visa)
He has renewed his TN 4 times.
He is now close to receiving an offer from my client, but his current company just filed his petition for a H1B visa.
Not sure what is best for him and new employer. Candidate just received an email from his HR that he can't travel during petition, but would the new job, he will need to go to Israel for training. Can he make a request to his current employer to withdraw his petition once he decides to change companies in order to do TN visa again?
Any help would me much appreciated.

You can have the new stamping done before 6 months of expiry of the current stamp in ur passport or within 1 year of it's expiry.

Nope, 140 was approved in 2006. 485 applied July 19th, 2007. Looks like a mistake on USCIS part.
Did you filed 140 & 485 concurrently?? this is also one of the uscis check that you shouldn't filed be concurrently...

Yes, it can be done. Basically, you have to show that the work experience is at least the equivalent of a College degree. There are people, called "evaluators" (or something like that) that analyse all the credentials and work experiences to determine that equivalence. Immigration attorneys know how to use those "evaluators" whose "evaluations" are usually accepted by USCIS.

I went to graduate school in the US, (majored in Architecture) and was on an F1 visa from the period 2006-2009.I graduated in Aug 2008 and applied for an H1 through a consultancy firm.The petition for an H1 visa was approved, but I decided to return back home anyway and came home in 2009.
2 weeks ago, I visited the States for a week for a conference on a B1/B2 visa. I eventually want to return to the States and work there and therefore, need advice in this regard...
Given that my petition for an H1 has been approved, will the company that offers me employment have to reapply for an H1 for me?Or can the H1 be transferred from the Consultant company(that got me the H1), to the new company easily?!
Any help in this matter will be highly appreciated!

Hello can anyone tell me the procedure to file I-539. I overlooked my wife's H4 visa (assumed visa will be renewed when i get my H1 renewed at consulate). I am looking for information to file for I-539
Also My wife's visa expires on Dec 9th 2007 (I94 expires on Dec 20th 2007). Is it possible for my wife to stay beyond Dec 20th if i dont receive the H4 renewal by that date. I am planning to file I-539 by Nov 8th 2007

I sent my documents for I485 on May 4th. Fedex web site shows that the documents were received by the service center on May 5th. But so far, my checks were not deposited or I haven't received the official receipt. How long does it take usually for USCIS to deposit checks? If I don't get the receipts for another week, what do I do?

have a couple of quick questions. It would be great if someone could
answer them for me.
(1) Do I need to leave my I-94 card in when I give them my
old passport? Is it OK if I remove it? Do they make a big deal of this?
(2) In the online form, what do I choose for the "Service Desired" field?
"Re-issue of passport"?

Not a lawyer- but my guess is that the date of validity on your H1b (First H1) is the day you can start counting your 6 years. This is regardless of when you started working for your employer.
Example: Employer sponsored H1 for Mr.X on April 2nd 2005. H1 approved with validiity starting 1st oct 2005. Mr. X flew to the USA in december 2005. Started working 15th jan 2006. The 6 years are counted from 1st Oct 05.
Now one can recapture all the months that the employee was on vacation. But I am not sure if this is still an option.
Example: Employer sponsored H1 for Mr.X on April 2nd 2005. H1 approved with validiity starting 1st oct 2005. Mr. X flew to the USA in december 2005. Started working 15th jan 2006. The 6 years are counted from 1st Oct 05.

My wife's company has filed for her H1B and she has been given the receipt number from her HR dept, but we are unable to check the case status online. whenver wetry to check the status of her case online it says
"Your case can not be found at this time in Case Status Online. Please check your receipt number and try again. If you need further assistance please call the National Customer Service Center at 1.800.375.5283"
i called up USCIS and they tell me that there is a technical problem and not all case status can be checked online ,they cannot give me any information on the status of the case and the rep said they can convey any info only to the HR dept of her company
However the rep confirmed that the receipt number is valid,
Has anyone had a similar issue? Not sure how i can go about this,
when my wife contacted her company's HR department says that they will keep her posted on any developments in her case
Pls share your experiences
